Description
Keep your company out of court ­ and your managers out of jail ­with this proven managing within the law legal training program. Included are the laws relating to wrongful termination, discrimination, harassment, defamation, and the Sarbanes-Oxley Act, which provides for up to 20 years in prison for falsification of documentation, and for up to 10 years in prison for firing whistle-blowers.

Although the program starts with these laws to set the context, the emphasis throughout the day is on the spirit of the law, providing your people with an ethical compass, and critical legal do’s and don’ts.  The content is updated annually, compliant with all state harassment laws,  and includes your organization’s key policies and procedures.

All facilitators are seasoned attorneys and highly engaging facilitators who use personal stories and appropriate humor to make topics relevant and engaging based upon years of experience in the courtroom and the classroom.

The program is highly experiential with small group discussions, video vignettes, skill building exercises, practice, feedback, extensive Q &A, and case studies based on actual legal cases.

Participants receive a comprehensive workbook and reference guide they can use again and again.

  • Being consistent
  • Having a legitimate business reason for decisions
  • Documenting: importance, electronic files, how to write it, what to share, and when to share it
  • Calling the experts: your management, HR, and legal team

III. Effective Performance Management

  • Treating employees fairly: good reason, progressive discipline, and performance appraisals
  • Setting expectations and performance coaching
  • Keeping your promises: policies, handbooks, and oral promises
  • Respecting whistle-blowing

IV. Preventing Discrimination

  • Stereotyping, glass ceilings, and reasonable accommodation
  • Hiring: behavior-based interviewing, illegal questions, and references policy
  • Understanding protected characteristics

V. Leading With Respect

  • Recognizing the causes of workplace harassment, discrimination, retaliation, and bullying
  • Learning why most workplace harassment and disrespect are unintentional
  • Addressing unconscious bias and microaggressions in the workplace
  • Being clear about what to do as a bystander to workplace harassment and discrimination
  • Learning a manager’s responsibility to prevent and respond to bullying, harassment, retaliation, and abusive conduct claims
  • Living the platinum rule for treating others with respect
